
Environmental charter
Constitutional LAW n° 2005-205 of March 1, 2005
The French people,
Considering:
That resources and natural balances have conditioned the emergence of humanity;
That the future and the very existence of humanity are inseparable from its natural environment;
That the environment is the common heritage of human beings;
That man exercises an increasing influence on the conditions of life and on his own evolution;
That biological diversity, personal development and the progress of human societies are affected by certain modes of consumption or production and by the excessive exploitation of natural resources;
That the preservation of the environment must be sought in the same way as the other fundamental interests of the Nation;
That in order to ensure sustainable development, choices intended to meet the needs of the present must not compromise the ability of future generations and other peoples to satisfy their own needs,
PROCLAIMS:
Article 1. Everyone has the right to live in a balanced and healthy environment.
Article 2. Everyone has the duty to take part in the preservation and improvement of the environment.
Article 3. Every person must, under the conditions defined by law, prevent damage that they are likely to cause to the environment or, failing that, limit the consequences.
Article 4. Everyone must contribute to repairing the damage they cause to the environment, under the conditions defined by law.
Article 5. When the occurrence of damage, although uncertain in the state of scientific knowledge, could seriously and irreversibly affect the environment, public authorities shall ensure, by application of the precautionary principle and in their areas of responsibility. attributions, the implementation of risk assessment procedures and the adoption of provisional and proportionate measures in order to prevent the damage from occurring.
Article 6. Public policies must promote sustainable development. To this end, they reconcile the protection and development of the environment, economic development and social progress.
Article 7. Everyone has the right, under the conditions and limits defined by law, to access information relating to the environment held by public authorities and to participate in the development of public decisions having an impact on the environment. 'environment.
Article 8. Environmental education and training must contribute to the exercise of the rights and duties defined by this Charter.
Article 9. Research and innovation must contribute to the preservation and development of the environment.
Article 10. This Charter inspires France's European and international action.

The Urban Geoportalnism (GPU)
The Urban Planning Geoportal (GPU) provides access to territorial planning regulations.
It allows each citizen to:

Locate your land;

Show and question the zoning and town planning regulations that apply;

Consult all or part of the town planning documents directly online (geographical data and municipal or intercommunity regulations);

Know the public utility easements affecting the use of your land;
-
Download geographic (zoning) and literal (regulations) data in .pdf format;
-
Display superimposed layers of information (selection of planning regulations, cadastral background, aerial photo, etc.);
-
Create and distribute your own map using drawing tools (prescriptions to represent, drawing tools).
It also allows professionals to carry out various studies using the data present there.

The town planning document
​
Any municipality wishing to plan its urban development can opt for one of these two local planning documents: the municipal map and the local urban planning plan (PLU).
The municipal map
The municipal map is a simple and graphic urban planning document for small municipalities that have not developed a Local Urban Planning Plan (PLU). It allows them to demarcate sectors where construction is authorized and where they can issue building permits.
The municipal map includes a presentation report and one, or more, graphic documents. It includes in annex the public utility easements affecting the use of the land. All of these documents and their cartographic representation made available on the GPU by the local authorities which are the competent authorities.
The PLU
The Local Urban Planning Plan (PLU) is a more sophisticated urban planning document which constructs a development project on the scale of a municipality or a group of municipalities (intercommunal PLU known as PLUi). It allows the municipality to fully adapt its regulations to the specificities of its territory, and in consistency with its general urban development project.
PLU(i) includes a presentation report, regulations (written provisions and graphic document), development and programming guidelines (OAP). It includes in annex the public utility easements affecting the use of the land.
In order to ensure the protection and development of remarkable heritage sites in the territory, a Protection and Development Plan (PSMV) can serve as a PLU.
Municipalities and public intermunicipal cooperation establishments (EPCI) are authorized to upload the urban planning documents in force on their territory to the Urban Planning Geoportal.

The Territorial Coherence Scheme (SCoT)
The territorial coherence plan (SCoT) is a long-term intercommunal strategic planning document (around 20 years) developed on the scale of a large living area or an urban area.
The SCoT consists of a Strategic Development Project (PAS), a orientation and objectives document (DOO) as well as annexes.
The communities responsible for SCOT are authorized to submit their SCOT on the Urban Planning Geoportal.

Public utility easements (SUP)
​
Public utility easements (SUP) are administrative limitations on property rights authorized by law for the benefit of public entities, service or public works concessionaires, and private individuals carrying out an activity of general interest.
They can impose constraints and sometimes prohibit the initiation or continuation of construction, development or demolition work.
The authorities responsible for public easements are very varied (they may be representatives of the State, local authorities, or national operators such as RTE, SNCF, Orange, etc.). They are each responsible for putting online the public utility easements for which they are responsible.
The Urban Planning Geoportal allows you to consult the geographical location, the zoning of the SUP as well as its legal file.
